What is Deferred Action?

The Department of Homeland Security, with Congress’ approval, has authorized a policy which allows children who grew up in the United States illegally – i.e., who were not legal citizens but were brought into the country when they were younger than 16 – to apply for legal status that will ensure certain rights. There are specific limitations and requirements that apply.

Deferred Action Eligibility

There are numerous requirements that must be met in order to qualify for deferred action, including, but not necessarily limited to the following:

  • The applicant must have entered the U.S. prior to age 16
  • Documentation must be provided in all requested areas
  • The applicant must have primarily resided in the U.S. for five years – prior to June 15, 2012
  • Most importantly, the applicant must be younger than 31 as of June 15, 2012
  • The applicant must be a veteran of the U.S. Armed Forces, or
  • The applicant must have proof of high school graduation
  • The applicant must pass a criminal background check
